Crossing Agreements, Easements, and Other Fees

Pursuant to the provisions of Section 49.212 of the Texas Water Code, the Board of Directors of the Gulf Coast Water Authority has adopted the following charges, fees, and rentals for providing or making available any district facility or service:

Encroachment Agreements

$50 Application Fee plus $500 Fee for Agreement

Abandonment of Right of Way/Easement Quitclaim Deeds

(for releasing easement rights)

$250 Application Fee plus $500 Fee for Agreement

Water Discharge Permits

$500 Application Fee plus $500 Annual Maintenance Fee

In each case, the standard fee is for execution of the standard form of agreement approved by district staff and/or counsel. If the district is asked to modify or negotiate any agreement, the party requesting the modification must reimburse the district for all costs incurred in addressing the request, including without limitation all attorney's fees and expenses. In addition, district staff is authorized to deviate from this Order if staff determines in a particular case that the cost involved in performing the requested service will exceed the standard fee set forth herein. The party requesting the service must also pay for any filing fees, recording costs, or other charges incurred with respect to the requested service.
